These terms govern use of StartUpJobs.co.nz (“the Platform”) by fractional executives and senior operators (“Talent”). By creating a talent account you agree to these terms, our Privacy Policy and the Fair Play Agreement, which forms part of these terms. Hiring businesses are covered by separate Client Terms of Service.
No listing fees, subscription fees, placement fees or deduction-based fees of any kind apply to talent members. You set your own rate, and you receive 100% of your quoted rate for hours approved on the Platform. If that ever changes, it will only be with your explicit prior agreement — not via an update to these terms.
You are responsible for the accuracy of your profile, including work history, availability and rates. As a condition of being listed in the directory, you consent to us:
Only nominate referees who have genuinely worked with you. We may decline or remove a listing where verification cannot be completed.
Engagements run through a single contract chain: the client contracts with the Platform, and the Platform subcontracts you under a contract for services generated digitally at the start of each engagement. You are an independent contractor, not an employee of the Platform or the client.
You are paid on approved timesheets via buyer-created tax invoices generated by the Platform — in plain English: we create the invoice for you, so you never have to issue one or chase one. You are responsible for your own tax obligations, including income tax and (where registered) GST.
Nothing in these terms restrains you from working with any party, in any capacity, on or off the Platform. No fee, deduction or restriction applies to you for taking work elsewhere — including with clients you met through the Platform. Where an engagement began on the Platform, we ask (via the Fair Play Agreement) that you keep that engagement on the Platform — but any obligations relating to off-platform conversion sit with the client, never with you.
Depending on the nature of an engagement, professional indemnity or public liability insurance may be required. Specific requirements (including minimum cover) are to be confirmed and will be stated in the contract for services for each engagement before you accept it.
The Platform is provided “as is”. We don’t guarantee any volume of work, introductions or engagements. To the maximum extent permitted by law, we exclude all warranties and limit our total liability to you to NZ$100. Nothing in these terms limits rights that cannot be excluded under New Zealand law, and nothing affects your right to be paid in full for approved work.
We may update these terms from time to time. Material changes will be notified via the Platform or by email before they take effect.
These terms are governed by New Zealand law and disputes are subject to the exclusive jurisdiction of the New Zealand courts. Questions: hello@startupjobs.co.nz.
